The Only Reason I Left part of this up is to see How Easy it is to Trick People into Thinking This is the LAW !

 

Section 404 of the Clean Water Act (CWA) prohibits the discharge of dredge or fill material into waters of the United States without prior Department of the Army authorization.  >{The use of dredge in waters of the United States for prospecting or treasure hunting would require a Department of the Army Permit.<That is Wrong .

 

Under Section 10 of the Rivers and Harbors Act, a Section 10 DA permit is normally required for work or structures in or affecting navigable waters of the U.S.  River such as the Coosa, Alabama, and Black Warrior, and their reservoirs are considered navigable waters of the United States, >and a Section 10 permit and a Section 404 permit would be required for prospecting or treasure hunting.< False  

 

The Corps of Engineers must ensure that projects authorized by a Department of the Army permit (pursuant to Section 10 of the Rivers and Harbors Act and Section 404 of the Clean Water Act) also comply with provisions of the Endangered Species Act (ESA) and the National Historic Preservation Act (NHPA). < True

 

In accordance with Section 106 of the National Historic Preservation Act (NHPA), any Federal agency “having authority to license any undertaking shall, … prior to the issuance of any license… take into account the effect of the undertaking on any district, site, building, structure, or object that is included in or eligible for inclusion in the National Register.”< True


The use of dredge in waters of the United States for prospecting or treasure hunting would require a Department of the Army Permit.< FALSE

This is so Easy to miss Unless You Know The Law !

From the Georgia Environmental Protection Department Office Mr Tilden Bembry
Dredging in the Chattahoochee river is permitted as long as you are not in any Park borders and you have to get permission from land owners and you do not need a permit from any state or county gov. office I will be adding more info as I get it
